The process of applying for Social Security Disability benefits is long and difficult. If you make the wrong move, you could RUIN your chances of getting benefits. In this video, David Henson--managing partner of HensonFuerst Attorneys--discusses what NOT to do during the application process.

Applying for Social Security Disability is tough. At the time when you are feeling bad enough to be considered disabled, the agency seems to want to make the process as difficult as possible. If you want to make their job easier, I can help you with that.
Hi, I'm David Henson, managing partner with HensonFuerst Attorneys. We help people through the long and exhausting process of attaining Social Security Disability benefits everyday. Of the many things we've learned along the way, one lesson is clear: The SSA looks for reasons to reject your claim. Here are the top 5 things you can do to help SS shut you out.

1. Don't get medical care for your conditions.

2. Do drugs or alcohol.

3.Break the law, or end up in jail.

4.Don't keep your lawyer up-to-date on your situation.

5. Miss deadlines or appointments.

If you work hard all your life, and end up so injured or sick that you can no longer work, you may be eligible to receive Social Security Disability benefits. But just because you are eligible, that doesn't mean you are entitled. There is a world of reasons why your case may be not be approved...don't hand the courts a reason to deny your claim.
This is David Henson, with HensonFuerst Attorneys. For more information about how we can help you fight for your SSD benefits, visit our website at LAWMED.com/SocialSecurityDisability/. Or, call us at 1-800-4-LAWMED.

I went to my hearing today, I am bipolar II ...I told the judge I've been drug free for the past 5 to 6 years, been getting mental health treatment for the past 2 1/2 years .. I havent been able to keep my jobs because of fights at work due to my mood swings and bad attendance at work..do you think me telling them about my past drug use and agressive behaviour can be a reason to deny my benefits? I was told by my lawyer to be honest and I was

They can use your ability to make appointments as proof you are not disabled.

Health care clinic refuses to release my medical records. I had to move out of area (was on Obamacare) and see another doctor after one failed SSDI application. No medical records showed up despite breast cancer, sigmoid colon resection, and other medical conditions. Now, I am destitute and have just reapplied. Physician I just saw noted physiological signs of sleep apnea of severe and chronic nature which may be why I have no energy, a “leaking heart valve,” and torn trapezius muscle on the right. Again, this California healthcare clinic refuses to issue my medical records - which are a chest x-ray, lab work. I have mitral valve insufficiency, a torn trapezius muscle on dominant right side, I have worked for 35 years in total. How can I get my medical records from this clinic?

I just got approved for disability. I have herniated and bulging disks from a fall at 24.

I have a chiropractor records that show I go almost everyday
I have an xray and and mri to show I'm injured
I have physical therapy (which doesn't work but I go anyway)
I have proof that I have been going for a year .

Everytime I cancel a doctors appointment I ask them to put in the notes that I'm in too much pain to get out bed and cant make my appointment

I did all the things that cause me injuries (bend over, do the dishes, walk) to show them what happens if I do day to day activities. As a result I couldnt walk and half crawled to get into the evaluation room

I was honest and explained I do have good days and if I have a good day I try to save it (resting though it and if i have a few good days in a row which is so rare I try to get out to do something even if it's just a walk in the park)

I explained how my injuries affected me and how hard it is to do day to day activities

I am approved now for disability.

Look at the listings of impairments to see if you qualify. https://www.ssa.gov/disability/professionals/bluebook/AdultListings.htm. You may have a very severe condition that may qualify you without much fuss. If you are older, more than age 55 and have worked at a strenuous job, your chances are good, even if you have used substances. Complete the function report honestly. Complete the work history report. If you don't remember your past jobs and dates, give estimates the best you can. And write on the form that the dates are estimated.

It took me 17 months to win mine with two denials and a hearing in front of administrative law judge and and then close to 90 days to start receiving benefits. I cannot count the times people ask me how saying they gave up after first denial. I always tell them to find a good law firm to represent you and a have a paper trail. My attorney received 25% of my back benefits for which I did not care. It's about securing the benefits for your disability not hitting the lottery and in addition your lawyer needs to get paid also. One of biggest excuses I hear is people don't want to have to pay attorneys fees which is a piss poor excuse. Not only that listen to your lawyer and do what he says so much as in people that don't follow their doctors orders and can't figure out why shit turned out wrong. My attorney once told me many claims are denied because of incomplete paperwork, missed deadlines done by people with know experience. Could go on forever here but one last thing is when you get your hearing before a judge how you present yourself and respond to his questions can be a factor. If you are truly disabled and know it do not quit.

If you have medical records of your illness it shouldn’t take years or months to receive the benefit. You pay into the system you should get help when you need it. You shouldn’t have to prove you deserve anything!

They need to overhaul the welfare system in the 21st century. A system where people continually live off the government, and make, leeching a way of life, will eventually bankrupt our system as we all know it.

I need help. I am 20 and have had severe anxiety since I was a child. I have worked in the past but that was only when I had someone put in a good word for me from working there. I dread interviews and do horribly at them, my anxiety is so bad I can't even talk to people. I didn't talk in class or to any students when I was in school, barely made it through high school. Currently living with my fiance and can't keep a job due to my anxiety and not being able to communicate as good as regualr people to my coworkers and customers. I stutter, shake, sweat and cant bring my words together, anytime I try to talk to someone it comes out as a mumbled mess that I cant even understand. Then this makes people think I'm stupid or retarded and it hurts my self esteem even more and my anxiety. My anxiety is so bad that sometimes when a stranger or someone I'm not 100% comfortable with talks to me I'm too busy worrying about being judged and dreading having to reply that I end up not understanding what they said. My mind will literally forget how to understand english which makes me freak out more. Its to the point now where I can't even go outside without my heart racing and shaking. I get anxious on the sidewalk! Thats how bad it is. And honestly I barely ever leave my apartment and have literally no freinds. I'm extremely lonely and get really depressed because I need a job but can't keep one, if I find a job where they don't fire me I end up quitting because my coworkers always treat me terribly because of my issue. I need to get ssd or ill be homeless becaus so currently don't have a job and wont be able to get one that I can do if I even get past the interview. My issue is this, how do I get accepted if I can't afford to pay for an attorney and to get screened. I am literally broke but if I don't do this I will be homeless. I heard it is basically impossible to get approved unless you have money lying around to pay for this. Not only that but they would want me to appear in front of a judge! Ive had to do that before and only got through it because I only had to say one word, but this time id be expected to answer questions and explain my case. Which is impossible, its really shitty to expect someone like me to be able to do that and to have thousands of dollars laying around. What can i do in my situation??

I get S.S.I. the worst thang you can do, at any point in the process is to disclose previous or current drug addiction!!! You can TAKE IT TO THE BANK, YOU WILL NOT NOW or EVER get disability!!! It's makes an Administrative Law Judge's decision easy.
Point is Your NOT GOING TO BE GIVEN ANY HELP, if they believe your going to use the money feeding a drug addiction!!! Administrative Law Judge's see this in your file.... Case Closed, Have a nice day.

Nowadays ANY pain management from your doctor is being vilified as America is conducting a war on pain relief.Anoither strike against you is if you were a self-employed white man all your life. There are too many bigoted SJW's in government and the former administration has sanctioned the bigotry toward white Americans to the point of outright injustice through government agencies.

Denial of benefit from someone who HAS paid in based on anything outside of Medical or Mental condition is consider Discrimination and Un-Constitutional. That in itself is a serious law suit. This guy seems to know a few law breaking oath breaking judges in PA it seems. The FBI should investigate these mass rejection based on bias outside of anything medical. :)

disabled apply for ssdi after putting in nearly 40 credits and still can only earn 1180...then people are forced to try to work until they are 62 or 65 (early retirement) and still won't receive much more. Then work til you are 70 and 75 or near dead just to get perhaps 2000 but by then... outrageous.

It's kinda strange to me. I have been paying into Social Security for over 40 years, YES 40 years and this lawyer tells me I'm not entitled to disability. I believe with all my heart, soul and mind I'm definitely more entitled to benefits for disability than the administration that took this money I earned on pain of criminal detention from me. My last job I worked 30 years with one employer, I'm now disabled and I'm so scared and worried I will be denied disability and income benefits because they have a record of denying Disability and I just turned 60 years old and after I pay into it for 35 years they changed the age to receive benefits to like 67 or 70 I'm not sure which one but talking about moving the goalpost in the final 1/4 of the game THAT IS NOT RIGHT! I have a few serious health predicaments and I don't even have health care anymore I have to be honest I'm scared about what is going to happen to me.

What I think is unfair.. I figured that I was going to have to go out on SSDI. I worked with the state of Florida.. I took out a disability ins, claim through met life. paid half my net income $800 a month... When I won my case Met life told me that I had to pay them all that money back that I got for them over 18 months or $14,400 they considered that back pay income.. Which they took it all still had to pay $50.00 more.. Called Tallahasse to the Insurance Commission they said this was legal... Hate it in one way was looking for to that $14,000 but glad that I had disability insurance and income coming in from my Sick Leave.

This whole friggin country is a joke. I personally know 2 people whose " shoulder hurts" so they cant work and get full disability. I have thalassemia which is an incurable genetic anemia and daily feel like im dying. I broke 2 vertibrae and have a herniated disc with degenerative arthritis which pinches the nerves giving me sciatica down my leg. Just found out i have elevated liver enzymes and a lump on my right side that nobody can identify. Heel spurs on both feet so walking with bonespurs , sciatica, and a broken back is agony! In addition, lately i cant breathe and have severe chest pain which also the doctors cant find anything wrong...and sleep apnea so i cant rest...always tired...exhausted...and due to the opiate crisis my doctors only offer physical therapy! How can i exercise if i cant breathe or move? Yet as a white hetero christian conservative male i HAVE to work...with no sympathy or help offered from my bosses or anyone else...paid into the system all my life too! We should all be able to collectively sue these bastards and take our money (and country) back! Best of luck to you all who suffer, God bless!

I need to call my lawyer. I think why the judge didn't say yes was because the lawyer was pushing my mental disorders more than my blindness and guess what? My eyes have gotten worse. I can't see long distances anymore even with my glasses and my close up vision (forgot what it was called) isn't any better. I couldn't even finish school (college) .
